AT&T is facing another lawsuit that alleges the carrier overcharges for data on the iPhone and iPad. The plaintiffs specifically point out “phantom” data charges that appear on the bill during times when the phone is not being used.
The class-action suit follows an extremely similar suit that was filed against the carrier in February. In fact, it appears that these lawyers are using the same evidence as the original suit, claiming overage charges of 7 to 14 percent on average, with some as high as 300 percent. The lawyers claim that an independent consulting company was called in to do tests on the iPhone and found that data charges were occurring at times when the phone was not being used and had no email accounts set up to sync, just like the previous lawsuit.
The lawyers contended that AT&T was making millions of dollars per month in overage charges, and likened it being scammed at the gas pump. It was not specified what the defendants were looking to achieve from the lawsuit, though the original lawsuit called for restitution and monetary damages. AT&T claims that the charges are false and the suit is without merit, and goes on to say that consumers do not understand how data is actually billed.
